• News: Under the terms of that certain Indenture of Trust (the Indenture), dated as of April 1, 2016, by and between the Public Finance Authority (the Issuer) and BOKF, NA (the Trustee), the Issuer issued its $6,855,000 Education Facility Revenue Bonds (Alice King Community School Project), Series 2016 (the Bonds). Payment of principal and interest on the Bonds is secured, in part, by that certain Loan ans Security Agreement (the Loan Agreement), dated as of April 1, 2016, by and between the Issuer and Alice King Community School Foundation (the Borrower). Capitalized terms used in this Notice and not defined herein shall have the meanings given to such terms in the Loan Agreement. The Trustee and the holders of a majority of the aggregate outstanding principal amount of the Bonds (the Majority Bondholders) are aware of the anticipated failure by the Borrower to make required payments under Section 5.02(a) of the Loan Agreement (the Anticipated Defaults) on each of the Monthly Disbursement Dates of April 25, 2018, May 25, 2018 and June 25, 2018 which represents a Default under Section 8.01(a) of the Loan Agreement. The Loan Agreement provides that, once the Trustee has sent notice to the Borrower pursuant to Section 10.01(d) of the Loan Agreement specifying a default under the Loan Agreement, the continuance of such default for a period of 30 days after such constitutes an Event of Default. Prior to the Trustee sending notice to the Borrower specifying the default under the Loan Agreement, the Borrower requested that the Trustee and the Borrower enter into a forbearance agreement related to such default (and prospective Event of Default). A copy of that Forbearance Agreement may be requested from the Trustee.
