- News: The Amended and Restated Bond Resolution applicable to each bond resolution provides that the amendment and restatement of such bond resolution provided for in such Amended and Restated Bond Resolution shall only become effective upon, among other things, in the event that written consents to the amendment and restatement of such bond resolution as provided therein of the Holders of at least two-thirds in principal amount of the Power Revenue Bonds or General Power Revenue Bonds, as applicable, then Outstanding shall be filed with the Trustee in the manner provided in Section 1103 of such bond resolution, the date on which the conditions set forth in Section 1103 of such bond resolution with respect thereto shall be satisfied. There heretofore have been filed with the Trustee the written consents to the amendment and restatement of each bond resolution provided for in the related Amended and Restated Bond Resolution of Holders of (a) $219,845,000 in aggregate principal amount of the Power Revenue Bonds Outstanding under the Power Revenue Bond Resolution and (b) $81,640,000 in aggregate principal amount of General Power Revenue Bonds Outstanding under the General Power Revenue Bond Resolution. As of January 1, 2017 (and giving effect to the payment on such date of the Principal Installments on the Outstanding Power Revenue Bonds or General Power Revenue Bonds, as applicable, due on such date), (x) $290,525,000 in aggregate principal amount of Power Revenue Bonds were Outstanding under the Power Revenue Bond Resolution and (y) $119,000,000 in aggregate principal amount of General Power Revenue Bonds were Outstanding under the General Power Revenue Bond Resolution. Accordingly, the Trustee has received consents that have not been revoked with respect to more than two-thirds in aggregate principal amount of (i) the Power Revenue Bonds Outstanding under the Power Revenue Bond Resolution as of January 1, 2017 (and giving effect to the payment on such date of the Principal Installments on the Outstanding Power Revenue Bonds due on such date) and (ii) the General Power Revenue Bonds Outstanding under the General Power Revenue Bond Resolution as of January 1, 2017 (and giving effect to the payment on such date of the Principal Installments of the Outstanding General Power Revenue Bonds due on such date). Therefore, the Holders of the applicable Bonds Outstanding have consented to the amendment and restatement of each bond resolution provided for in the applicable Amended and Restated Bond Resolution, and such amendment and restatement will be effective as provided in Section 1103 of such bond resolution.
