• News: The purpose of this notice is to inform you that the Trustee, acting pursuant to Section 8.11 of the Indenture at the direction of the holders of a majority in aggregate principal amount of Bonds Outstanding (the Directing Bondholders), has waived certain Events of Default and defaults under the Indenture, the Lease, and the Loan Agreement. Specifically, the following Events of Default and defaults (collectively, the Waived Defaults) have been waived at the direction of the Directing Bondholders: 1) The failure of the Lessee to maintain an unrestricted working capital balance and cumulative unrestricted cash reserves at the minimum levels required by Section 10.08 of the Lease as of July 1, 2016, which constitutes an Event of Default under Section 12.01(d) of the Lease, and which in turn constitutes an Event of Default under 2 Section 10.01(h) of the Loan Agreement and under Section 8.01(d) of the Indenture by operation of the relevant cross-default provisions;
