- News: This notice is provided by Wells Fargo Bank, National Association, as successor Trustee, Paying Agent and Tender Agent under that certain Trust Indenture dated as of July 1, 2009 (the Indenture) between the Dallam County Industrial Development Corporation (the Issuer) and Wells Fargo Bank, National Association, as successor to The Bank of New York Mellon Trust Company, N.A., as trustee (the Trustee), pursuant to which the Bonds were issued. Capitalized terms not otherwise defined herein have the meanings assigned in the Indenture. Hilmar Cheese Company, Inc. and HCC Properties Ltd. (collectively, the Borrower) have provided notice to the Trustee and Tender Agent that pursuant to Section 2.12(b) of the Agreement and Section 6.08 of the Indenture, the Borrower will provide an Alternate Letter of Credit to the Trustee on April 5, 2018 in substitution for the Letter of Credit presently in effect, together with the opinion required by Section 6.08 of the Indenture. Accordingly, the Trustee and Tender Agent hereby give notice that the Bonds shall be subject to mandatory tender, pursuant to Section 3.03B of the Indenture, on April 5, 2018. As permitted under Section 3.03B of the Indenture, this notice may be revoked not less than three Business Days prior to the mandatory tender date set forth in this notice.
