  • News: Each Disclosure Undertaking also provides that it may be amended ""as may be necessary or appropriate ... to address any change in circumstances arising from a change in legal requirements, change in law, or change in the identit nature, or status of LES, or type of business conducted by LES"". Subsequent to the execution of the Disclosure Undertakings, the Southwest Power Pool`s integrated marketplace system has rendered the information disclosed under those headings commercially sensitive and the disclosure of such information puts disclosing utilities at a competitive disadvantage. The Nebraska Public Power District, which manages both Gerald Gentleman Station and Sheldon Station, has required that LES enter into non-disclosure agreements as a condition to receiving energy cost and energy rate information relative to each of those plants. Consequently, LES is no longer able to include such information in its Annual Report. On February 28, 2017, a Nebraska district court judge ruled that such information is not required to be released to the public under Nebraska state law. That ruling concluded that the release of such information does not serve a public pu{pose and could place Nebraska public utilities at a competitive disadvantage. As a consequence of the changes in the legal requirements relating to the disclosure of the Energy Cost Information, LES has elected to amend the Disclosure Undertakings so as to remove the requirement that LES include the Energy Cost Information as an element of its Annual Reports. Except as amended hereby, the Disclosure Undertakings remain in full force and effect.
