- News: The City of Chicago Heights, Cook County, Illinois (the City), pursuant to issuing its Taxable General Obligation Bonds, Series 2009 (Build America Bonds Direct Payment to Issuer) (the 2009 Bonds), Taxable General Obligation Refunding Bonds, Series 2009A (the 2009A Bonds) and Taxable General Obligation Bonds, Series 2011 (the 2011 Bonds and, together with the 2009 Bonds and 2009A Bonds, the Prior Bonds), entered into applicable prior undertakings (each the Applicable Prior Undertaking) to disseminate its audited financial statements and certain annual financial information (together, the Annual Report) with respect to the Prior Bonds as required by Rule 15c2-12 of the Securities Exchange Act of 1934 (the Rule). Pursuant to each Applicable Prior Undertaking, the City covenanted to file its Annual Report within a certain number of days of the Citys fiscal year end (April 30) through the Electronic Municipal Market Access (EMMA) system established by the Municipal Securities Rulemaking Board in accordance with the Rule. The City failed to file certain data to be included in its annual financial information for fiscal years 2012-2016 pursuant to each Applicable Prior Undertaking with respect to the Prior Bonds. Further, the City failed to file its Annual Report within the required timeframe for fiscal years 2013 and 2016 pursuant to each Applicable Prior Undertaking with respect to the Prior Bonds. The completed Annual Report for the fiscal year 2016 has since been posted on EMMA. The Citys failure to comply under each Applicable Prior Undertaking does not constitute a default under the bond ordinances for the Prior Bonds. The City has put procedures in place to ensure timely compliance with all of its continuing disclosure undertakings.
